By using this website and/or placing an order with Agents Aperture Ltd, you confirm that you have read these Terms and Conditions of use and our Privacy Policy (collectively referred to as the “Agreement”), and that you understand and agree to be bound by all of the terms within this Agreement.
These Terms and Conditions may be revised at any time, and you are advised to review them regularly as they are binding on all users of our services and website.

1. Ordering
1.1 Orders can only be accepted via our online booking form (within the login area) from registered users. Once submitted, an email containing the order details will be sent to the Agent. It is the responsibility of the booking Agent to check all details and notify us within 1 hour of any errors.
1.2 Once an order has been received, we will contact the Client (or booking Agent) to arrange a suitable time for the visit.
1.3 Once the visit time has been confirmed with the Client, the booking Agent will be notified via email of the arranged date and time.
1.4 Orders may be declined for the following reasons:
- Our Terms and Conditions are not met or agreed to
- There has been a description or pricing error
- The service is no longer available
- The Agent has an overdue invoice
1.5 Upon completion of the work, digital files (including download links) will be delivered electronically via the company cloud.
2. File Delivery and Storage
2.1 Upon completion of each job, the final files (or links) will be sent to the Agent or branch the next working day via email, containing a link to the company cloud.
2.2 Files will be stored on the company cloud for 28 days. After this period, they will be archived.
2.3 Non-digital files such as printed brochures will be delivered directly to the booking branch.
2.4 For interactive floor plans and virtual tours, a link will be provided that can be embedded into other websites or shared directly.
2.5 Content hosted on the Agents Aperture website (including 360° tours and interactive floor plans) will remain online for 1 year from the date of the property visit. Continued hosting after this period will incur additional charges.
3. Payment
3.1 Regular clients will receive an invoice via email at the end of each month.
3.2 All invoices must be paid within 28 days, unless otherwise agreed in writing.
3.3 Non-regular clients must pay for bookings in advance. The booking will only be arranged once payment in full has been received.
3.4 Overdue invoices will incur daily interest at a rate of 8.5% on the amount overdue, excluding any additional costs for legal recovery.
4. Cancellation and Returns Policy
4.1 Once a job has been completed and all files have been sent to the booking Agent or Client, no refunds can be issued. This does not affect your statutory rights.
4.2 If access to the property is denied on the scheduled day of the visit, the booking will be charged in full with no obligation to re-visit.
4.3 Cancellations must be made no later than 24 hours before the booking time. Cancellations made with less than 24 hours’ notice will be charged in full due to the short-notice time slot being unlikely to be filled.
5. Photography
5.1 The entire copyright of all photographs remains with Agents Aperture Ltd at all times throughout the world.
5.2 The Agent is responsible for ensuring an authorised representative is present during the shoot to approve the photographer’s interpretation. If no representative is present, the photographer’s interpretation shall be deemed acceptable.
5.3 Clients must ensure the property is ready and staged appropriately before the visit. Properties will be photographed as presented upon arrival.
5.4 Outbuildings, garages and annexes will not be photographed unless specifically requested in writing at the time of booking. Roof rooms without fixed staircases will not be photographed.
5.5 In the event of high winds, elevated mast photographs will not be taken. Eye-level images will be substituted and charged at 50% of the booking fee to cover costs.
5.6 Each booking covers one visit only. Re-visits due to the property not being ready will incur additional charges.
5.7 Photography is subjective. While we make every reasonable effort to produce aesthetically pleasing images, no liability is accepted if the Client or Agent is dissatisfied due to personal preference. If photographs are shown to be inadequate in complying with the order, the Agent may request a re-shoot within 48 hours of file delivery. A free re-shoot will be offered if the issue is proven to be the fault of our photographer; otherwise, full re-shoot charges will apply.
6. Floor Plans
6.1 Floor plans are for illustrative purposes only and should be used as a visual guide to the property layout. Measurements and details are approximate, and no responsibility is accepted for errors or misstatements.
6.2 Floor areas are calculated wall-to-wall where possible and include stairways and landings. Roof rooms and restricted head height areas are measured at floor level. Bay windows are only included if accessible by foot.
6.3 Floor plans re-drawn from client-supplied plans are direct copies. Agents Aperture Ltd accepts no liability for their accuracy.
7. Day to Dusk Editing
7.1 If the image to be converted was not taken by Agents Aperture Ltd, a high-resolution version must be provided.
7.2 The Day to Dusk process is fully digital and does not involve visiting the property.
7.3 Only visible lights will be digitally illuminated unless specific instructions are provided before editing.
7.4 Converted images are typically returned within 24 hours.
8. Virtual Staging
8.1 If the image to be digitally staged was not taken by Agents Aperture Ltd, a high-resolution version must be provided.
8.2 Rooms to be staged must be entirely free from furniture or clutter. If removal is required, additional costs will apply.
8.3 Specific furniture placement requests must be made at the time of ordering; later changes will incur extra charges.
8.4 Final staged images are typically returned within 48 hours.
9. Photo Editing
9.1 Basic photo editing (at the editor’s discretion) includes:
- Straightening
- Cropping
- Blue sky replacement
- Brightening or darkening
- White balance adjustment
9.2 Object removal (e.g., skips, bins, vehicles) is classed as advanced editing and will be charged additionally.
10. Video Editing
10.1 All videos are edited to a basic standard at the editor’s discretion.
10.2 Additional services such as drone footage, audio, or night-time filming will be charged separately.
11. Limitation of Liability
11.1 Agents Aperture Ltd shall not be liable to the Agent or Client for:
- Loss of profits
- Loss of sales or business
- Loss of agreements or contracts
- Loss of anticipated savings
- Loss or corruption of software, data or information
- Damage to goodwill
- Any indirect or consequential loss
11.2 Total liability is limited to the total charges paid for the services under the Contract.
11.3 The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded to the fullest extent permitted by law.
12. Miscellaneous
12.1 All images produced for an Agent may be used by that Agent for marketing materials, property listings, and self-promotion. The Agent’s parent company may also use the images solely for marketing the specific property photographed.
Ownership of all images remains with Agents Aperture Ltd. A non-transferable licence is granted only to the Agent and their parent company. Any third-party use (including developers, architects, builders, designers, sellers or buyers) is strictly prohibited unless approved in writing by Agents Aperture Ltd.
12.2 Agents Aperture Ltd processes personal data in accordance with the UK GDPR and Data Protection Act 2018. Please refer to our Privacy Policy for more details.
12.3 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
